No criminal charges have been filed against a man who was arrested along with his teenage son in connection with a fatal stabbing in Grant Hill, authorities said Wednesday.

Emilio Torres Valencia, 37, and his 17-year-old son were arrested following Friday’s stabbing and fight, with the father booked into county jail on suspicion of murder. On Wednesday, the day of his scheduled arraignment, a San Diego County District Attorney’s Office spokeswoman said charges were not filed in the case.

San Diego police identified the victim on Wednesday as Moises Duarte, 36, of San Diego. The altercation occurred near 27th Street and L Street, where officers found Duarte with at least one stab wound and head trauma.

He was taken to a hospital, where he died shortly afterward.

Police said the suspects and Duarte had a prior disagreement stemming from vandalism at the same location about a month ago.

San Diego police said the investigation is continuing.

Duarte’s 15-year-old son was temporarily detained by officers at the scene, then released to his mother. Authorities said he will not face charges.
