The biotech firm Illumina announced Friday that a federal jury awarded it $26.7 million in a patent infringement suit filed against Ariosa Diagnostics.
The San Francisco-based jury found that Ariosa’s previous and current version of the Harmony non-invasive prenatal test infringed on two U.S. patents owned by San Diego-based Illumina, company spokesman Eric Endicott said.
The jury rejected counterclaims by Ariosa that Illumina had breached a supply agreement between the companies by bringing the lawsuit, Endicott said.
The U.S. Patent and Trademark Office previously upheld the validity of the patents, rejecting multiple challenges filed by Ariosa, according to Endicott.
Endicott said Illumina plans to seek an injunction in response to Ariosa’s continuing sale of its Harmony test.
