San Diego County accuses major sushi supplier of forcing grocery sushi chefs to ‘pay to work’
A new lawsuit filed by San Diego County alleges that a major sushi supplier is violating labor laws through classifying sushi chefs as independent contractors.
ACE Sushi — a company that operates in some of the region’s largest supermarket chains — offers grab-and-go sushi for retailers to stock in deli sections. You might see the sushi chefs preparing the rolls in stores, in addition to participating in promotions and sometimes delivering sushi.
But they aren’t getting paid for their time, instead compensation is based on how many products are sold.
Attorneys say this is anything but a reasonable arrangement. In many cases, they contend that family members of the chefs even have to step in to help them meet ACE Sushi’s contractual requirements to the grocery stores.
These chefs are classified as “franchisees,” but attorneys say they are essentially bearing the burden of typical business expenses and losses; meanwhile ACE avoids paying minimum wages, overtime and paid sick leave and providing rest and meal breaks.
Keeping it legal: A proposal to build a mega-church in Del Cerro has been green-lit by a Superior Court Judge. Unless there’s a decision to appeal, this will mark the end of a years-long, back-and-forth fight between Del Cerro residents, some city council members and church leaders.
Residents, banded together under the moniker Save Del Cerro, have argued a environmental review must be done to review traffic safety and the impact of the church on weekend traffic. However, the judge said the environmental review was up to par with CEQA requirements.
